Terms of Service

Welcome to Westside Tech Guys. Westside Tech Guys is a family-operated business providing general technical assistance and support for Apple devices. Some services may be performed by a supervised junior technician under the direction of the business owner. By requesting or using our services, you agree to these Terms of Service.

1. Services

Westside Tech Guys provides general technical assistance and support for Apple devices, including but not limited to device setup, troubleshooting, software guidance, account assistance, and general tech support ("Services"). Services are provided on a residential, in-person, or remote basis as agreed upon with the customer. Services do not include hardware repairs, component replacement, or forensic data recovery.

2. Customer Responsibilities

Customers are responsible for providing accurate information about their devices and issues, backing up important data before service when possible, and ensuring a safe environment for service to be performed. Customers acknowledge that Westside Tech Guys will remove Activation Lock where necessary to complete requested services.

3. No Guarantee of Data Preservation

While reasonable care is taken, Westside Tech Guys does not guarantee that data, files, settings, or accounts will be preserved during any service. This includes, but is not limited to:

Customers are strongly encouraged to back up their devices prior to any appointment.

4. Limitation of Liability

Westside Tech Guys is not liable for any indirect, incidental, or consequential damages arising from services performed, including but not limited to:

Liability, if any, is limited to the amount paid for the specific service.

5. Existing Device Conditions

Westside Tech Guys is not responsible for hidden or pre-existing faults with a customer's device that are discovered or worsen during the course of service, including but not limited to:

6. Apple and Third-Party Services

Westside Tech Guys is not affiliated with, endorsed by, or sponsored by Apple Inc. Apple ID, iCloud, Face ID, Touch ID, Find My, and the App Store remain under Apple's control, and Westside Tech Guys is not responsible for the availability, performance, or policies of these services.

7. Customer Authorization

By requesting services, the customer authorizes Westside Tech Guys to access the relevant device(s) for the purpose of completing the requested service, including device access, adjusting settings, installing or removing applications, performing software updates, connecting to Wi-Fi, and signing into Apple services using credentials provided by the customer.

8. Privacy

Any login credentials or personal information shared during the course of service are used only for the purpose of completing the requested service and are not retained afterward unless otherwise requested by the customer.

9. Youth Technician

Westside Tech Guys is a family-operated business. Some services may be performed by a supervised junior technician under the direction and supervision of the business owner. Services are provided on a best-efforts basis, and there is no guarantee that every issue will be resolved.

10. Payment

Payment is due upon completion of service unless otherwise agreed upon in advance.

11. No Warranty

Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Westside Tech Guys does not guarantee that issues will be resolved, that devices are repairable, that future software updates will not cause issues, or that service will be uninterrupted.

12. Governing Law

These Terms of Service are governed by the laws of the State of Hawaiʻi.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Force Majeure

Westside Tech Guys is not liable for delays or failure to perform services due to circumstances beyond reasonable control, including but not limited to weather, illness, or emergencies.

15. Customer Acknowledgment

By booking an appointment, the customer acknowledges and agrees that they are the owner or authorized user of the device, that they have backed up their data or accept the risk of not doing so, that they understand the inherent risks of technical service, that they have read and agree to these Terms of Service, and that they authorize Westside Tech Guys to perform the requested service.
